"Only a moron in a hurry" could confuse Apple's iTunes Music Store from Apple Corps' record label, or so says Apple lawyer Anthony Grabiner -- a comment that an AP article calls "
an oft-repeated legal argument." Oft or not, even reporters in
Beijing are keeping close tabs on the Beatles' old record company's effort to get Apple to
change its logo. One suggestion from perennial pundit John Dvorak: Apple should simply
change its name and be done with the whole Apple vs. Apple contretemps. Remember John? He's the guy who also suggested that
Apple should switch to Windows. We'll file both suggestions under "Not bloody likely."
In other news: Some observers are
congratulating Apple for
its latest iPod software update, which allows you to limit your iPod's -- or your kid's iPod's -- volume level, while others aver that by releasing the update, Apple has
admitted that the iPod is flawed. Either way you look at it, according to Macs Only, the update is

Microsoft has acknowledged that a planned update to the way Internet Explorer renders multimedia on Web pages could cause some serious problems, and promised to give developers an extra two months to modify their pages to ensure a smooth transition.
The Redmond company was forced to make the changes in response to a patent dispute with Eolas Technologies. The fix would affect the way ActiveX controls are displayed on Web pages, according to experts. If no changes were made, a user would have to "activate" an ActiveX or Java control before it would be usable.
An update containing the modification was made available as an optional download earlier this month.
That patch to be delivered to all users on April 11 as part of the company's Patch Tuesday program would deliver an update with the change. Along with this download, another would be provided that would hold off the ActiveX changes through June, the company said. Affected HTML controls include the APPLET, EMBED, and OBJECT elements.

The world continues to wonder what the European push for interoperable DRM schemes will mean for the iTunes business model. One obvious choice is for Apple to maintain its current model and just
close the French iTunes Music Store. Others suggest that Apple should
abandon DRM altogether and use file tagging to catch copyright violators instead. Or, they could try a
voluntary licensing approach. A poster to an International Herald Tribune technology blog speculate that the French could
come up with their own DRM technology for use in the French market. (Hm, would that be the good French technology like in
Rayman 2, or the bad French technology like in our old
Peugeot 403?) And here's a guy who says the whole
concept of DRM is flawed anyway. Meanwhile, over in England, Apple Corps is
continuing its legal assault on Apple's use of an apple logo to sell music (a story we love if only for its use of the term "disco classic"). Maybe Apple's tired of being yelled at and that's why the latest iPod software update includes a
volume limiter. Thinking of putting an iPod in your car? Try out Crutchfield's

in-dash interface for controlling everything from your iPod to your iron. On the home entertainment front, Apple's got a patent in Europe on a way for a computer to
synchronize and equalize multiple speakers--a handy feature for any future Mac-based home theater system. They've also joined
Bapco, a group of companies that work on (til now) Windows benchmarks, leading to speculation that Apple is going to
embrace the idea of running Windows on MacTel machines--or that, more likely, they want to get some
OS X-on-Intel benchmarks in the works. Now that's tiny: Western Digital's new
6GB USB hard disk (not flash drive) measures 2-1/2 by 1-3/4 inches. And if you're sick of looking for the right font, consider picking up the
ITC Library Open Type Edition ($3,899 for a 10-seat license), which contains over 1,650 type styles, including
some you may have heard of. And last, as Apple's 30th birthday approaches, Wired has collected some of
Steve Jobs's greatest sayings. And while he may be one of Barron's
top 30 CEOs, we're willing to bet Steve won't get a knighthood--unlike, oh, say,

Technology giants Microsoft Corp. and Yahoo Inc. are planning to build massive data storage centers amid the sagebrush and farm fields of rural central Washington.

"This could be a real boon to Quincy, and to Grant County," said Curt Morris, Port of Quincy board president. "It's bringing renewed optimism to the people of the town, especially the business owners. We're interested to see where it takes us."
The developments come as Microsoft, Yahoo, Google Inc. and Time Warner Inc.'s America Online, as part of efforts to compete for customer loyalty, are boosting e-mail, video and other services that require lots of storage space.
"Data centers like this are what contains the family jewels," analyst Rob Enderle said. "They're looking for low-cost real estate and stable sites in terms of weather and geographic activity. It means they've done some work and determined it's one of the least-expensive, safest places they can build."
Quincy, population 5,300, has long been an agricultural hub in Washington. Trains carry railcars loaded with apples, potatoes, onions and hay to points east and west, and food processors and packing sheds comprise most of the city's industrial base.
The city sits hundreds of miles from Microsoft's lush Redmond headquarters near Seattle, yet the Fortune 500 company has signed a tentative agreement to buy 74 acres in one of Quincy's five rapidly filling industrial parks. The price: $1 million.
"The Quincy area is attractive to Microsoft for a number of reasons: space available, the land, the access to power, and the close proximity to our headquarters here, which is always good for us," Microsoft spokesman Lou Gellos said by phone from Redmond.

Today brings more overseas drama for Apple, this time accompanying the launch of a new
Universal Pictures service in the U.K. that allows folks to purchase downloadable versions of movies along with a DVD -- a possibly ill omen for the future of an Apple-branded downloadable Movie Store. Meanwhile, some business deals in Taiwan seem to indicate that Apple is indeed
working on an iPhone -- some sort of "iPod with phone functions," according to the Australian magazine
Smarthouse. While the article calls it a "confirmation," we'll wait until Apple uses that word before we hurl our ROKR in the trash. Back at home, the recently announced delay of Microsoft Vista to January is
good news for Apple; but Microsoft has a few harsh words for
Apple regarding how Cupertino handled the recent Mac virus "scare." A wise man once said, "Before you remove the splinter from your brother's eye, get rid of the plank in your own" (or something to that effect), but in this case, we're talking less of a plank and more of a large National Park. Since the Motorola Rokr's disappointing launch, iPod lovers have been hotly anticipating a cell phone that really does the job of playing music and fielding calls with equal aplomb. Now, it looks likelier than ever that Apple is actually working on such a device, which observers have dubbed the "iPhone." Smarthouse, an Australian tech magazine, reports on its website that Apple has approached several Taiwanese contract manufacturers to build the product for it. "Among manufacturers in Taiwan it is common knowledge," says an unnamed executive at BenQ, a Taiwanese maker of cell phones and handhelds. The BenQ executive's comments follow analyst reports that Hon Hai Precision or Taiwan Green Point Enterprises may land an iPhone contract. [
